Governing Law and Jurisdiction (Outside EU)

Both you and Costa, Branco Costa, Lda, agree that this dispute resolution procedure is a condition precedent that must be satisfied before initiating any litigation or filing any claim against the other party. If any dispute cannot be resolved by the above dispute resolution procedure, you agree that the sole and exclusive jurisdiction for such dispute will be decided by binding arbitration on an individual basis. Arbitration on an individual basis means that you will not have, and you waive, the right for a judge or jury to decide your claims, and that you may not proceed in a class, consolidated, or representative capacity. Other rights that you and we would otherwise have in court will not be available or will be more limited in arbitration, including discovery and appeal rights.

The arbitrator will have exclusive authority to resolve any dispute relating to arbitrability and/or enforceability of this arbitration provision, including any unconscionability challenge or any other challenge that the arbitration provision or the agreement is void, voidable, or otherwise invalid.  The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity.  Any award of the arbitrator(s) will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction.

You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location.

What is alternative dispute resolution?

Alternative dispute resolution is an extrajudicial procedure for resolving disputes, whether nationally or internationally, relating to contractual obligations arising from sales contracts or service provision contracts between a trader established in the European Union and a consumer resident in the European Union. European Union, through the intervention of an alternative dispute resolution entity that proposes or imposes a solution or acts as a bridge between the parties with the aim of facilitating an extrajudicial solution to the dispute.

Alternative dispute resolution entities are extrajudicial entities. An alternative dispute resolution entity is a neutral party (i.e., a conciliator, mediator, arbitrator, ombudsman or complaints director) that CBC and the customer can turn to to resolve disputes if the customer opts for alternative dispute resolution . The alternative dispute resolution process is a low-cost, simple and quick procedure, which is why it is beneficial for both consumers and traders, who will be able to avoid legal costs and lengthy procedures.
